Georgia injury deadlines
The statute of limitations sets the last day to file. Some claims need notice much sooner.
| Claim | Deadline | Source |
|---|---|---|
| Personal injury | 2 years | O.C.G.A. 9-3-33 |
| Property damage | 4 years | O.C.G.A. 9-3-31 |
| Notice to a city | 6 months | O.C.G.A. 36-33-5 |
| Notice to a county | 12 months | O.C.G.A. 36-11-1 |
| Notice to the State | 12 months | O.C.G.A. 50-21-26 |
Exceptions
- Minors: the clock may be paused until age 18 for some claims.
- Pending criminal case: may toll the deadline against the accused.
- Product claims: also subject to a 10-year outer limit from first sale.
Filing isn’t the same as notice. For government claims, the notice must be correct in content and timing.
